The Ministry publishes a clarifying note on the entry into force of ECODESIGN for manufacturers and distributors of stoves and pellet and firewood fireplaces

As of January 1, 2022, neither the sale to the end consumer nor the installation of wood or pellet stoves and insertable hearths that do not comply with REGULATION (EU) 2015/1185 on ecological design or ECODESIGN will be allowed.

 

The Ministry of Industry, Commerce and Tourism of the Government of Spain has published on its website a clarification on application of Delegated Regulation (EU) 2015-1185 that affects local solid fuel heating appliances, which are basically all stoves and homes with a power equal to or less than 50kW.

These clarifications on the application of REGULATION (EU) 2015/1185 OF THE COMMISSION of April 24, 2015 by which Directive 2009/125 / EC of the European Parliament and of the Council is applied in relation to the ecological design requirements applicable to solid fuel local space heaters are:

 

  1. Regarding marketing and commissioning.

Article 3. Ecodesign and calendar requirements. Solid fuel local space heaters shall meet the requirements eco-friendly design established in Annex II as of January 1, 2022.

 Article 8 Transitory provisions. The regulation published in 2015 allows until January 1, 2022, the commercialization and entry into service of local solid fuel heating appliances that comply with current national regulations. Therefore it is interpreted that As of January 1, 2022, neither the sale to the final consumer (commercialization) nor the installation of devices (entry into service) that do not comply with REGULATION (EU) 2015/1185 will be allowed..

 

  1. Regarding the exception contemplated in section e) of Article 1 section 2 for products for heating the air:

It is understood that wood or pellet stoves and fireplaces are solid fuel local heating devices, as established in Article 2, paragraph 1) on definitions and they are not products to heat the air as defined in Article 2 paragraph 8.
